2. TIMING: The Promotion begins 6/28/21 at 9 AM PT and ends on 7/11/21 at 11:59 PM PT (the “Promotion Period”), when all entries must be received. Pacific Time shall control for all purposes of this Promotion. Sponsor’s clock shall be the official timekeeper for the Promotion.
3. HOW TO ENTER: To enter the Promotion, Entrants must follow @Rinse_Inc and @OxiCleanOfficial on Instagram, LIKE this post, and tag someone in the post who empowers them, to receive 1 entry. Entries must be received by Sponsor no later than 7/11/21 at 11:59 PM PT to be eligible for the random winner drawing. Limit 1 entry per person. Entries by the same person in excess of the limits stated herein will be disqualified. Entries will be deemed to have been submitted by the authorized account holder of the email address associated with the Instagram account from which entry is made at the time of the entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Entering or attempting to enter the Promotion multiple times through the use of multiple Instagram accounts is prohibited and any such entries will be deemed void and disqualified. If your social media posts are set to “private mode,” your responses may not be received by Sponsor. Although it is free to enter the Promotion, standard message and data charges may be incurred if you use your mobile device to submit your entry.
4. PRIZES: One (1) winner will receive a prize package consisting of a $250 USD Rinse credit issued via a discount applied to their account, as well as a one (1) year supply of OxiClean products, awarded in the form of one (1) case of 7.22 lbs consisting of four (4) units of product, with a total approximate retail value of $44.00. Please allow 2 to 4 weeks for prize delivery. Taxes on prize, if any, are solely the responsibility of the winner. Winners of a prize valued at $600 or more will receive a Federal Tax Form 1099. We recommend that you consult with your tax advisor if you have further questions. Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion, unless such substitution is prohibited by law. Sponsor may disqualify a winner and select an alternate winner if any prize is returned undeliverable. Prizes are non-transferable. Sponsor need not substitute a prize based on the winner’s request.
5. WINNER SELECTION: On or about 7/12/21, one (1) winner will be randomly selected from all valid and eligible entries received during the Promotion Period. Odds of winning depend upon the total number of valid and eligible entries received during the Promotion Period. Sponsor’s decisions will be final and binding. Winning Entrant will be notified via their Instagram post or direct message. The potential winning Entrant must respond to Sponsor’s prize notification via email within 72 hours from the date and time of the Sponsor’s prize notification and may be required, in Sponsor’s discretion, to sign and return an affidavit of eligibility and release (where permitted by law) in the form provided by Sponsor (the “Affidavit”). In the event that the potential winning Entrant does not respond to Sponsor’s prize notification within the specified time or the prize notification is undeliverable or if potential winning Entrant fails to sign/return Sponsor’s Affidavit, a new winner will be randomly selected from among the other eligible entries received. Alternate winners will be contacted via Instagram post or direct message and must respond to the Sponsor’s prize notification within 72 hours from the date and time of the Sponsor’s prize notification and may be required to sign/return Sponsor’s Affidavit.
6. LIMITATIONS ON LIABILITY: Sponsor and its respective affiliates, subsidiaries, parent corporations, advertising and promotional agencies, and all of their officers, directors, shareholders, employees, and agents are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions, or defects of any telephone network, computer online system, computer equipment, servers, providers, or software, including any injury or damage to Entrant's or any other person's computer relating to participation or inability to participate in the Promotion; inability to access the Sponsor’s website, mobile applications or social media outlets or upload information or data; theft, tampering, destruction, or unauthorized access to, or alteration of, Entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer, or electronic malfunction or traffic congestion on telephone lines or the Internet or any website or mobile application or for any other reason whatsoever; printing or other errors; or any combination thereof. Proof of uploading information or data or entering information at Sponsor’s website or social media outlets is not considered proof of delivery or receipt. Illegible, duplicate and incomplete Entries will be disqualified. False, fraudulent, or deceptive entries or acts shall render Entrants ineligible and all associated entries will be void.
7. INDEMNITY: Entrant shall indemnify and defend Sponsor, Church & Dwight Co., Inc. and their respective parent companies, subsidiaries, affiliates, divisions, and each of Sponsor’s advertising agencies, and the officers, directors, employees, and agents of all of the foregoing and the successors and assigns of each of them, from and against actions, claims, damages, liabilities, costs and expenses, including reasonable counsel fees related to (i) Entrant’s use or misuse of any prize, (ii) the Sponsor’s use of any of the materials submitted by Entrant in connection with this Promotion or (iii) any intentional misconduct or negligence by Entrant in connection with this Promotion.
8. RELEASES: As a condition of participating in the Promotion, Entrants release and hold harmless Sponsor, Church & Dwight Co., Inc., Instagram, and their respective parent, subsidiaries, agencies, divisions, affiliates, employees, officers, directors and members from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including property damage, personal injury and death that may occur in connection with, preparation for, travel to, or participation in the Promotion, or possession, acceptance or use or misuse of prize or participation in any Promotion-related activities and claims based on publicity rights, copyright or trademark infringement, defamation or invasion of privacy and merchandise delivery.
9. GENERAL CONDITIONS: Potential winning Entrants are subject to Sponsor’s verification. Sponsor’s decisions are final and binding in all matters related to the Promotion. Potential winners must comply with these Official Rules, and receipt of prizes is contingent upon fulfilling all requirements. Sponsor is not responsible for technical, hardware or software failures, malfunctions, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or unforeseen schedule changes that may limit an Entrant’s ability to participate in the Promotion, even if caused by Sponsor’s negligence. Sponsor has the sole discretion to modify, cancel or suspend this Promotion should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control affect the administration, security or proper play of the Promotion or Sponsor otherwise becomes incapable of running the Promotion as planned. Sponsor is not responsible for changes to Entrant’s contact information. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with the Promotion, shall be resolved individually, without resort to any form of class action, and shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. In addition, any dispute relating to the Promotion (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in California. Entrants hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction that they may have. Any and all claims, judgment and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees and under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and further waives any and all rights to have damages multiplied or otherwise increased.
10. COLLECTION OF INFORMATION: Information collected in connection with the Promotion will be collected in accordance with Sponsor’s Privacy Policy, available at https://www.rinse.com/privacy. By participating in the Promotion, each entrant agrees to the terms of Sponsor’s Privacy Policy.
